1Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, or “your”) and FistAi Technologies(“FistAi”, “we”, “our”, or “us”).
By creating an account, authenticating via Google OAuth, accessing the fistai.in website, or integrating our chatbots and APIs into your digital infrastructure, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
If you are registering on behalf of a company, organization, or other legal entity, you represent and warrant that you possess the requisite authority to bind that entity to these Terms.
2Services & Platform Architecture
FistAi provides an enterprise suite of AI workforce tools, including:
- Autonomous AI Agents: Task-executing, intent-scoring agents capable of automated workflow triggers and multi-step decisions.
- Custom Conversational Chatbots: Embedded customer support widgets equipped with sentiment scoring, ticket deflection, and lead qualification.
- Curated Agent Knowledge Bases: Manual policy configuration, structured business guidelines, FAQ databases, and verified factual grounding pipelines.
- AI SEO Audit Tools: Automated technical audits, web crawler insights, and keyword content gap analyzers.
FistAi continuously enhances and iterates on these services. We reserve the right to modify, upgrade, or temporarily deprecate features with advance notice where commercially reasonable.
3Accounts, Authentication & Security
To access the FistAi dashboard and deploy agents, you must register an account. You agree to:
- Provide accurate, current, and verifiable registration details.
- Maintain the confidentiality of your session tokens, API keys, and credentials.
- Promptly notify us at security@fistai.in if you detect unauthorized access or credential compromise.
- Remain solely responsible for all actions conducted under your account credentials.
4Acceptable Use Policy (AUP)
You agree not to use or facilitate the use of FistAi Services to:
- Violate Laws or Safety Guidelines: Distribute illegal, harmful, abusive, harassing, fraudulent, or defamatory content.
- Deceptive Impersonation: Mislead end-users regarding human vs. AI agent identity in jurisdictions where disclosure is mandated by law.
- Malware & Cyber Attacks: Probe, scan, stress-test, or execute denial-of-service (DoS) attacks against FistAi APIs or servers.
- Reverse Engineering: Decompile, reverse-engineer, extract source code, or scrape model weights without prior written authorization.
- Circumvent Usage Limits: Bypass rate limits, token quotas, or tier restrictions.
Violations of this Acceptable Use Policy may result in immediate suspension or permanent termination of your workspace.
5Customer Data & Intellectual Property Ownership
6AI Output Accuracy Disclaimer
Artificial intelligence, large language models, and automated agents operate probabilistically. While FistAi implements advanced grounding, RAG indexing, and intent verification to maximize response fidelity:
- No Guarantee of Flawless Output: AI outputs may occasionally contain inaccuracies, hallucinations, or incomplete advice.
- Human Oversight Recommended: For mission-critical decisions (e.g., medical, legal, financial, or safety-critical matters), human review should always be maintained.
- Customer Evaluation: You are responsible for testing, prompting, and validating agent behavior before deploying to production users.
7Subscriptions, Fees & Billing
FistAi offers subscription tiers and usage-based plans. You agree to pay all applicable fees specified in your service plan:
- Billing Cycles: Subscription fees are billed in advance on a recurring monthly or annual basis.
- Taxes: Unless explicitly stated, fees exclude applicable goods and services taxes (GST), VAT, or local sales taxes.
- Cancellations: You may cancel your subscription anytime via the workspace dashboard. Your access will remain active until the end of the current billing cycle.
- Refunds: All payments are non-refundable once processed, except as required by applicable consumer law.
8Service Availability & SLA
We target a 99.9% uptime availability for our core APIs and agent gateways. However, uptime commitments exclude scheduled maintenance windows, third-party upstream outages (e.g. cloud provider incidents), or force majeure events.
Enterprise SLA tiers with dedicated support and compensation credits are available under custom enterprise master services agreements.
9FistAi Intellectual Property
The FistAi platform, including all proprietary software, user interface designs, algorithms, logos, trademarks, and documentation, are the exclusive property of FistAi Technologies and its licensors.
You may not copy, replicate, create derivative works of, or distribute any part of the FistAi platform without our express written consent.
10Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall FistAi, its directors, employees, or partners be liable for:
- Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.
- Errors, hallucinations, or actions taken by end-users relying on AI-generated output.
- Total aggregate liability exceeding the total amount paid by you to FistAi in the twelve (12) months preceding the incident giving rise to the claim.
11Indemnification
You agree to indemnify, defend, and hold harmless FistAi and its affiliates from and against any third-party claims, liabilities, damages, and legal costs arising out of your breach of these Terms, your Customer Data, or your end-users’ unlawful use of deployed AI agents.
12Termination & Suspension
We reserve the right to suspend or terminate your access to the platform with immediate effect if you breach these Terms, fail to pay invoiced amounts, or conduct actions that jeopardize system security or other customers.
Upon termination, all rights granted to you will immediately cease, and you must cease using all API keys and deployed embed scripts.
13Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
